Terms and Conditions

Thank you for choosing 1st Class Travel. Please review all terms and conditions below for your travel plans. Inspect your Reservation and Invoice carefully and verify the travelers’ names Exactly match your passports or any other documentation required for your travels. Also, you must confirm dates of travel and details are correct. Any changes to this itinerary will be subject to penalties. including any changes to the names on the reservation.

Please review the following information regarding your reservation.

It is the your responsibility to provide correct documentation for travel, failure to do so may result in denied boarding by airlines, rail, tour and cruise companies. Regrettably, we are unable to refund unused flights, hotel nights, or other features included with reservations due to denied boarding situations.

Deposits placed on confirmed reservations are non-refundable. Once final payment is received,1st Class Travel charges a cancellation fee in the amount of 10% of the total fare, in addition to any fees charged by the tour, rail or cruise companies. Tour operator and cruise company cancellation penalties vary, please contact our office for more details.

Your Agreement with 1st Class Travel

1. Health and Other Hazards: 1st Class Travel is an independently owned and operated travel business (“Agency” or “we”). You have requested the Agency book travel on your behalf. You acknowledge and agree that it is your personal decision to travel, and neither the Agency nor anyone on Agency’s behalf has induced you to make these arrangements. You acknowledge and fully understand that the travel arrangements may be interrupted or cancelled by the associated travel supplier, governments, or other third parties outside of the Agency’s control for reasons that are foreseeable and unforeseeable, including, as it relates to the ongoing COVID-19 pandemic. The Agency assumes no responsibility for, and shall not be liable, for cancellations, changes, unsafe conditions or health hazards including, injury, illness, disease, epidemics, pandemics and/or other illnesses or travel related events. We have no special knowledge of the safety, dangers, conditions, or enforcement of stated COVID-19 policies during travel or at destinations. For information related to such risks, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International Travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. The Agency is not responsible for the failure of other persons or entities to fail to follow or enforce COVID-19 rules, regulations, stated practices or policies.

2. Rules of Travel Suppliers and Governments: We have no responsibility for current requirements, or subsequent changes or modifications, that travel suppliers and governments have imposed or may impose from time to time, such as health affidavit forms, quarantine requirements, health screenings, prior to departure or upon arrival, including face coverings, or quarantines, including those related to all pandemics or epidemics including COVID-19. For the latest COVID-19 government travel regulations, we recommend reviewing IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. For the latest travel supplier requirements, check the supplier’s home page. It is your responsibility to assure your compliance and knowledge as to these matters.

3. Financial Condition of Travel Suppliers: We are not responsible for the acts or omissions of travel suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge, or control, regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit in lieu of a refund.

4. Rebooking: If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, but for bookings confirmed after September 1, 2020, we will charge a nonrefundable fee for such services.

5. Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold 1st Class Travel harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy. 1st Class Travel has no expertise or authority in regard to insurance claims or coverage determination. Any questions regarding insurance claims, insurance forms, or insurance company policies must be addressed directly with the company managing the travel insurance policy. 1st Class Travel and its employees cannot assist with insurance claims or filings.

6. RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED IN PARAGRAPHS 1-3 ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS. You hereby agree to hold Agency harmless and release it from any and all liability for any damages including, without limitation, monetary losses, damage to person or property, illness/disease, delays, negligence, or inconvenience, that you, or your travel companions, may incur as a result of the your trip.

7. Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your travel ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in Cape Girardeau County, Missouri, will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts, and waive any right to jury trial.

Effective January 2007, all travelers leaving the United States or returning to the United States from a non-US territory via air will be required to carry a valid US passport book. Passports may be required for Alaska and Hawaii cruises as well. 1st Class Travel encourages all cruise passengers to carry valid U.S. passport books for cruises.

Check your passport's expiration date. If your passport expires within one year, we strongly recommend you renew your passport now, allow ample time for passport processing. Most countries require passports to be valid for at least 9 months after your return date of travel. You may also be required to have blank pages left in your passport book, in addition to Visas for your travels. If you have questions regarding the validity of your passport, or any documentation required for your travels, please contact our office immediately.

Please note, if your passport is found to be washed, mutilated or damaged in any way, you may be refused entry into the country you are traveling to, or denied boarding at the airport in the U.S.

U.S. Citizens should be aware, many countries can deny foreigners entry if they have been charged or convicted of what that country considers a serious crime. For those traveling to Canada, anyone with a criminal record (including misdemeanors or alcohol-related driving offenses) may not be able to enter Canada without first obtaining a special waiver well in advance of any planned travel. To determine whether you may be inadmissible and how to overcome this finding, please refer to the Canadian citizenship and immigration website. For further information on entry requirements, travelers may contact the Canadian Embassy at 501 Pennsylvania Avenue NW, Washington DC 20001, 202-682-1740; or the Canadian consulates in Atlanta, Boston, Buffalo, Chicago, Dallas, Detroit, Los Angeles, Miami, Minneapolis, New York, San Juan or Seattle.

FAA Hazardous Materials Policy

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Please refer to the full list of TSA prohibited items at http://www.tsa.gov/traveler-information/prohibited-items. For further information contact your airline representative. In the event of increasing fuel costs many airlines, cruise lines, and tour operators will add fuel surcharges to travel packages. According to the travel suppliers, they reserve the right to pass these fuel surcharges or new taxes on to the customer at any time, even if the final payment has been received on the travel package. While we do not expect more charges to this package, these charges cannot be anticipated and are not included in the current price.

Airlines recommend check-in at least two to three hours prior to departure. Proper identification will be required at airport check-in. For information on COVID-19 procedures please go to: https://www.tsa.gov/coronavirus. Flight numbers and flight times are subject to change, please re-confirm your flight numbers and times 24 hours prior to your departure. Airlines may charge fees for checked bags, carry-on bags, oversized luggage, and overweight luggage. Please confirm the specifications for your luggage with the airline prior to your departure. Seat assignments with the airlines, including upgrades which are purchased, are not guaranteed by the airlines, and are subject to change. Please note, some airlines may charge a fee for pre- assigned seats or seats in preferred areas. Airlines will not guarantee any assigned seat, and some seats may only be assigned at the airline check-in counter.

Traveling with minor children: If all legal parents or guardians are not traveling with minor children, please inquire about additional documentation required. If you are pregnant or taking an infant on a cruise, please inquire with the cruise line about the restrictions their company has in place regarding pregnancy and infants.

Liability Limiting Terms and Conditions: 1st Class Travel, hereinafter, referred to as the Agency, issued this invoice in the sole capacity of agent for the owners, wholesalers and/or contractors, whose names appear on the face of this document and who are hereinafter referred to as Suppliers of the transportation and/or other services specified. As such the sole financial liability of the Agency is limited to the transportation and /or services on behalf of the named Client. This invoice is issued to any and all terms and conditions under which any transportation or other service is provided by the Suppliers, The Agency shall not become liable for any personal injury, property damage, accident, delay, inconvenience, change in itinerary or accommodations, or other irregularity which may occur due to (1) wrongful, negligent or arbitrary acts or omissions on the part of the Suppliers, their employees or others not under the direct control of the Agency; (2) defects or failures of any conveyance, equipment or instrumentality under the control of the Suppliers; and (3) but not limited to Acts of God, fire, acts of governments or other authorities, wars, civil disturbances, riots, strikes, thefts, pilferage, epidemics, quarantines or dangers incident to the sea, land and air.

The Client, by engaging the Agency and making deposit and/or full payment for the travel arrangements specified, acknowledges the position of the Agency as stipulated by the foregoing, agrees to hold the Agency blameless in making the arrangements on his behalf, provided same shall be made through generally acceptable Suppliers at the time of engagement, and further agrees that restitution or damages, if any are claimed, shall be sought directly from the suppliers. The Client further agrees to abide by the terms and conditions of the Suppliers of the services to be performed. In addition, the Client acknowledges that insurance was available that would provide compensation for lost or damaged luggage, trip cancellation, medical expenses and Supplier bankruptcy while planning or on the trip.
